Hearing Loss

If you served in the armed forces and now experience hearing loss and or tinnitus—a ringing or buzzing in the ears—you may be eligible for compensation, if you served after 1987.

Military personnel are often exposed to excessive noise in various ways, including gunfire, explosions, aircraft noise, or the sounds of ship engine rooms. Hearing damage can occur suddenly, such as from a gunshot, or gradually over time if you are near loud machinery or equipment. No matter the cause, you may be able to seek compensation.

In 1987, changes in the law lifted Crown Immunity in certain cases, making the Ministry of Defence (MOD) potentially liable for injuries or illnesses resulting from service. Although military life is not like any other job in terms of daily duties, the law views it similarly when it comes to compensation for injuries. You may be entitled to financial compensation if your hearing damage was caused by:

• Lack of adequate hearing protection

• Insufficient health and safety training

• Delayed diagnosis or misdiagnosis of hearing loss

• Lack of supervision or guidance during training

It is estimated that up to 300,000 current and former military personnel may have suffered from hearing loss or tinnitus due to negligence.
